Legal Eagles, is this fraud?

The Leper of the board.
Bloke at work is thinking of applying for a council house using his wife and kids on the application (to make sure he gets a big enough place for the kids to stay when he goes) I've told him it's mental and if he gets found out he will get screwed for fraud.

He reckons that it's ok providing his wife let's him have the kids at the weekend.

Told him he's off his rocker but he is literally falling apart in front of me.

He's actually a decent bloke who's just had enough of "being treated like a twat".

However if he will end up in a worse situation by lying I need to make sure I can get through to him.

Firstly, he needs full time custody of the kids and needs to prove it.

A few questions if he has.

How old are they?
Is he being made homeless?
Does he have any long term mental health issues or disability?

Three mid teens I think.
No he lives with his wife but if he walks he has nothing.
Not that I'm aware.

He would need to prove he has custody then.

He wouldn't get any priority with no long term illness or disability or dependent children. He would be signposted to a homeless hostel, private rent or shared house.

Do they own the house he wants to leave?

Well from what you've said so far he won't be considered priority so he'll be in the bottom band, which means it will take him years to get a property. If he tries to claim he has custody and can't prove it he will only be able to apply for a one bed. If he somehow tries to show he has custody and gets found out it is fraud. They probably won't prosecute but he will be banned from the council register for something like 3 years.

If you can find out if they own their property then I can give you (him) even more bad news.

Is he white?

If yes then he has no chance

Tell him to get a dinghy from Calais and claim to be from Somalia - straight to the top of the list and problem solved
