It isn't fact. It is untrue. Present the video evidence however you want. The French and British vessels monitoring the boat deemed it dangerous to intercept the boat. Safer to allow it to continue to protect people's lives. I see no facts being presented. I see propaganda.

Having thought about it more I'm not sure why it matters whether it was closer to France or Britain. If it was dangerous to intercept it then why would you. I defer to the expertise of people who work for the RNLI/French Coastguards.
