The FA have the special share in the PL and have governance over the rules and the rules were changed to fast-track, after we were relegated...
 
The fast-track rules were brought in, even though the rules are due to change again this summer.
Not sure how they can charge us under the new fast-track rules, when we weren't a PL team and then change the rules before we might re-enter the PL?

Are they charging us under the new fast track rules? From the PL:

"Leicester City were relegated to the EFL Championship before the Premier League’s new Standard Directions, which prescribe a timeline within which PSR cases should be heard, came into force. Therefore, the proceedings will be conducted in accordance with a timetable to be set by the independent Commission."

But, that is just about timing, the substance of the rules themselves haven't changed and, yes, as I mention in another thread, I think this whole PL member/non-PL member piece lies at the heart of our defence.
 
Well they didn't charge us with anything before the new Standard Directions and those directions are a change in timeline as you have stated. Even if the rules remain the same, the implementation of them has been altered.

In theory (not sure fact), they missed the deadline to charge us under the old directions and we weren't a PL club when the new directions came into force.

So to charge us would (I don't know legally), potentially be a retroactive application?

The Premier League have already acknowledged on their website that they can't directly make a decision about us, "Leicester City were relegated to the EFL Championship prior to the introduction of the Premier League’s new Standard Directions, which prescribe a timeline within which PSR cases should be heard." The EFL can't charge us, because we have only been in that division for a year. The independent commission have a tough task...

Under the old directions they could in theory I think have charged us at any time after the audited accounts were submitted, they only missed the deadline precisely because we weren't a EPL club when the PSR transgression was recognised. Before the new directions, the transgression would have only become apparent once the final audited accounts for 2022/23 were made available to the EPL which would have to have been no later than March 1st 2024. However, because we are not a premier league club, it appears we have not provided them to the EPL either by the old or new deadline as we don't have to, just to the EFL (but presumably we have coughed up to breaking the PSR threshold in our discussions with the EPL for them to have charged us).

As I say though, I think the club's approach is a risky strategy. Kind of letter of the rules vs the spirit. But it in undeniably a problem for the EPL that we are not a member club & something that the independent commission will have to sort through (btw the only difference I can see between this commission and the one that Forest & Everton have is that their powers extend to setting the timeline, they are all convened by the EPL).

And suppose the independent commission rule in our favour, the EPL will then have a grudge against us for the next 20yrs, just like the EFL have.
We can't win this, in the long run.

If only our leaders had put as much effort into ensuring we would comply, as they have with fighting the charges.

I doubt we were overly popular anyway for leading resistance to the calls for games televised during COVID to be subject to PPV but even if not, in relation to any potential positive future relationship with the EPL, I suspect that ship sailed yesterday with the commencement of legal proceedings against them.

We can't win this, in the long run.
I tend to agree that one way or the other that seems likely unless - but I think that this would be a real stretch though not completely outside the realms of possibility - other clubs swing behind us (which yesterday's statement seems to hint is the hope). But I think it is just so unlikely and, they - and we - all presumably having agreed to the rules in one way or another, would be a little difficult for us & they to justify.

Still, for anybody who genuinely believes that the rules are fundamentally wrong and restrict legitimately held (& financially supported) ambitions (and plenty on here appear to be amongst them), here's the chance to test them.
